Whereby Agent agrees to rent to Tenant(s) the following property: 

Reserved Property Name & address
Together with the personal property contained therein, and the use of the recreational facilities which are associated with such unit for a term:
Arrival:   {reservations.startdate} and Departure: {reservations.enddate}. (Total number of nights: {reservations.days_number}.)
Reservation deposit (25% of total payment) is due with the signed agreement.  The balance of your RENT, CLEANING & TAX will be DUE IN FULL 60 DAYS prior to CHECK-IN.

Tenant shall occupy the Unit in a quiet and dignified manner, protecting its contents against damage, loss or theft and shall obey all Rules and Regulations of the Condominium Association and acknowledges receipt of the same.  

CHECK-IN:  Check-in time is any time after 2:00 P.M.  You may pick up your keys at THE GULF REALTY RENTAL OFFICE, at 1960 Beach Road, Englewood, FL 34223, 9:00 A.M. to 5:00 P.M., Monday – Friday, or 9:30 A.M. to 3:30 P.M. on Saturdays.  If you plan to arrive after hours or on Sunday, prior arrangements must be made with us to pick up your key.  In case of an after-hours maintenance emergency, please call (941) 475-1036 for instructions.  
CHECKOUT:  Checkout time is any time before 10:00 A.M. on {reservations.enddate}.  If you remain in your unit after the end of your rental period, prorated rent plus taxes may be charged and deducted from your security deposit.

CANCELATION POLICY: Refunds, minus a $100 cancellation fee, will be made only if written notice of the cancellation is received 90 days or more prior to the scheduled arrival date.  Should tenant cancel during the 90-day time period, they shall forfeit all payments made unless Gulf Realty Rentals, Inc. is able to re-rent the unit for the same rental period at the same rate.  It is understood by the tenant that the forfeited sums represent liquidated damages owed to the owner as a result of having held the property off the rental market at the specific request of the tenant.  Tenant will be in default of this agreement if they fail to pay any sums required herein, and the rental unit will be placed back in the rental market and the reservation deposit will be treated as above.  If, for any reason, the unit becomes unavailable to rent, the Rental Agent agrees to refund all the money paid and tenant agrees not to hold claims against the rental agent.  

CLEANING & DAMAGES:  A reasonable cleaning fee has been charged.  Laundry in excess of three loads or any other excessive cleaning required after tenant’s departure may result in extra charges that will be deducted from the security deposit.  In addition, any damage caused by the tenant or any charges for service calls for misuse or mistreatment of equipment (i.e. garbage disposal blockage) will be deducted from the security deposit but is not necessarily limited to the amount of the security deposit.  Normal wear and tear is taken into consideration.  Repairs and maintenance problems must be brought to the Rental Agent’s immediate attention or tenant will be held liable for the damages.

KEYS:  Two (2) sets of keys will be issued at check-in time and should be returned keys to this office upon departure.  Service charge for lost or unreturned keys is $5.00 PER KEY.

MAXIMUM OCCUPANCY: 4 people in a 2-Bedroom unit or 6 people in a 3-Bedroom unit, or all members of an owner’s immediate family are allowed at any one time.

PARKING: Parking varies by property.  Parking passes, if required, will be provided and must be displayed in all vehicles at all times.

PAYMENTS:  We accept Visa, MasterCard, Discover, American Express or personal checks , cashiers' checks, travelers checks, money orders made out to Gulf Realty Rentals, Inc., or cash.  The 3% booking fee normally charged is waived for payments made by cash or check. 

PETS:  No pets allowed.   

RESERVATION/SECURITY/CLEANING DEPOSIT: Deposits are held in a non-interest bearing account with SunTrust Bank, Gulf Coast, Englewood, FL 34223.  None of the Deposits received and held by Agent shall result in the payment of any interest thereon to Tenant. Upon departure the Agent will hold the Security Deposit pending determination that the Unit and its contents are left by Tenant in the same condition at the end of the term as they were in the beginning.  At that time the security deposit will be returned, less the cost of repairing or replacing any part of the Unit or its contents or for any additional charges to remove property left by Tenant in the Unit, replacement of keys or recreational equipment, or extraordinary cleaning cost. The Agent shall have 15 days from Tenant’s departure to return the deposit or 30 days to impose a claim.

SHOWINGS:  In the event this unit becomes available for sale, tenant agrees to allow the unit to be shown to prospective buyers with a reasonable notice given to Tenant. 


UTILITIES:  The Owner pays for electricity, water, sewer, garbage collection, and cable television.  Internet and phone service vary by unit.  Changes or upgrades to service must be scheduled at least 30 days prior to check-in.  Please be considerate by closing the doors & windows when the air-conditioner is turned on.  Any utility charges in excess of $150 per month are the responsibility of the tenant and will be deducted from the security deposit.

FORCE MAJEURE: Neither party shall be liable in monetary damages for any delay or default caused by conditions beyond its control including, but not limited to, acts of God, government restrictions, wars, terrorist act(s) and/or any other cause beyond the reasonable control of the parties.  This includes, but is not limited to, mechanical, utility, electronic, or communications failure. 

RADON GAS NOTIFICATION: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.  Levels of radon that exceed federal and state guidelines have been found in buildings in Florida.  Additional information regarding radon and radon testing may be obtained from your county public health unit.
